The extension allows beneficiaries to maintain their TPS and EAD through March 2024

WASHINGTON— The Department of Homeland Security (DHS) posted a Federal Register notice for public inspection describing how beneficiaries under the existing Temporary Protected Status (TPS) designation for Venezuela can re-register to retain TPS and renew their Employment Authorization Documents (EADs). Secretary of Homeland Security Alejandro N. Mayorkas previously announced the 18-month extension of Venezuela's TPS designation.

Only beneficiaries of the initial TPS designation for Venezuela who were already residing in the United States as of March 2021 are eligible to re-register for TPS and apply to renew their EADs, provided they continue to meet eligibility requirements. Individuals who re-register must do so during the 60-day re-registration period from September 8, 2022, through November 7, 2022. Venezuelans who arrived in the United States after March 8, 2021, are not eligible for TPS.

Due to processing timelines for TPS re-registration applications, DHS recognizes that not all re-registrants may receive new EADs before their current EADs expire on September 9, 2022. The Federal Register notice automatically extends the validity of EADs previously issued under the TPS designation for Venezuela through September 9, 2023.

It has been estimated that approximately 323,000 individuals were eligible for TPS under the initial designation of Venezuela. There are currently about 111,700 beneficiaries under the TPS designation for Venezuela.

USCIS will continue processing pending applications filed under the initial TPS designation for Venezuela. Individuals with a pending Form I-821, Application for Temporary Protected Status or related Form I-765, Application for Employment Authorization do not need to re-file either application. If USCIS approves a Form I-821 or Form I-765 filed under the initial TPS designation for Venezuela, USCIS will grant the individual TPS through March 10, 2024, and issue a new EAD valid through March 10, 2024.

Venezuelans (and individuals without nationality who last habitually resided in Venezuela) who are currently eligible for TPS under the existing designation but have not yet applied for TPS must file their applications by the initial application deadline of September 9, 2022. Those who do not currently reside in the United States or who arrived in the United States after March 8, 2021, are not eligible for TPS.
